1. Acceptance of Terms

By accessing growth-agency.co.za or purchasing any of our packages, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use our services.

2. Services

Growth Agency (Pty) Ltd provides website design and development, web application development, and developer placement services. All deliverables are outlined in the package you select at checkout.

3. Payment & Billing

A once-off setup fee is charged at the time of order. Monthly subscription fees are billed on the same calendar date each month. All amounts are in South African Rand (ZAR) inclusive of 15% VAT. Payment is processed via PayFast, Stripe, PayPal, or Paystack in sandbox/demo mode.

4. Minimum Contract Term

All packages carry a minimum 3-month subscription term. After the initial term, subscriptions continue on a month-to-month basis and may be cancelled with 30 days written notice.

5. Ownership & IP

Upon full payment of the setup fee and all outstanding subscription fees, the client owns the final website design and code. Growth Agency retains the right to display the project in our portfolio unless otherwise agreed in writing.

6. Client Responsibilities

Clients must provide all required content (text, images, branding) within 14 days of project commencement. Delays caused by late content delivery may affect launch timelines without penalty to Growth Agency.

7. Limitation of Liability

Growth Agency's total liability shall not exceed the total fees paid by the client in the preceding 3 months. We are not liable for indirect, consequential, or incidental damages.

8. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Disputes shall be resolved in the courts of Pretoria, Gauteng.
